Terms of Service

The agreement between you and Truscan when you use the API or the dashboard. Plain language, and short where it can be.

1. The agreement

These terms are between you and Truscan Inc., 111B S Governors Ave # 82225, Dover, DE 19904, United States. By creating an account or calling the API you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

2. Your account

  • You must give accurate registration details and keep them current.
  • You are responsible for everything done with your credentials, so keep your password and API keys secret.
  • An API key is shown once. If you lose it, revoke it and create another.
  • Tell us promptly if you believe an account or key has been compromised.
  • One person or organisation per account. Do not share credentials to avoid paying for usage.

3. Acceptable use

You may not use the service to:

  • Break any law, or infringe anyone's intellectual property or privacy.
  • Circumvent rate limits, billing, or any technical restriction, including by distributing requests across accounts to obtain free credit repeatedly.
  • Probe, scan or attack our infrastructure, or attempt to reach internal endpoints.
  • Send queries designed to retrieve child sexual abuse material, or content that facilitates terrorism or violence.
  • Resell raw API responses as a competing search API without a written agreement with us.
  • Overwhelm the service in a way that degrades it for others.

We may suspend an account immediately where use threatens the service or exposes us to legal risk. Where it is safe to do so, we will contact you first.

4. Credits, pricing and payment

Payments are processed by Dodo Payments acting as merchant of record. They are the seller of record for each transaction, they issue the invoice, and they calculate, collect and remit any VAT, GST or sales tax due in your country. Charges appear on your card or bank statement as DODO_TRUSCAN, not as Truscan. Their terms apply to the payment itself, alongside these terms which govern your use of the service.

  • The service is pay as you go. There is no subscription, seat charge or minimum.
  • Every account receives a free credit grant each month. It renews monthly and does not accumulate.
  • Usage is charged against your credit balance in millionths of a dollar, counted as whole numbers.
  • A request served from cache is not charged. A page that failed to load is not charged.
  • Prices are quoted in United States dollars. Any tax due is added and shown at checkout before you pay.
  • We may change prices. Existing credit is unaffected, and we will give at least 30 days notice by email before a change takes effect.
  • If your balance reaches zero, requests are refused until you top up. We do not extend credit.

Top-ups are non-refundable, and any refund must be started within 30 days of the payment because of a limit imposed by our payment provider. The Refund Policy sets out the narrow exceptions and how to raise a billing error.

5. Availability

We aim for high availability but we do not currently offer a contractual uptime commitment. We may change, suspend or withdraw features, and we will give reasonable notice of a change that breaks a documented interface.

Planned maintenance is scheduled outside peak hours where we can. Emergency maintenance may happen without notice.

6. Results and third-party content

The service returns content published by third parties on the open web, together with a ranking score. We do not own that content, we do not verify it, and a high score is a signal about agreement between sources, not a statement that something is true.

You are responsible for how you use what the service returns, including respecting the rights of the sites the content came from, and for any decision you or your systems take on the basis of a result.

7. Intellectual property

We own the service, the software and our brand. You own your data and anything you build with the API. Nothing here transfers ownership either way. You may use our name to say that you use us; do not imply that we endorse you.

If you send us feedback, we may use it without obligation to you.

8. Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or close an account that breaches these terms, that is used unlawfully, or where we are required to.

If we close your account for a breach, unused credit is forfeited. If we withdraw the service entirely, we will refund unused credit on a pro rata basis.

9. Disclaimer

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that results will be accurate, complete or uninterrupted.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or 100 United States dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, in which case the exclusion applies only to the extent permitted.

11. Indemnity

You will indemnify us against claims, damages and reasonable legal costs arising from your use of the service in breach of these terms or in breach of the law.

12. Changes to these terms

We may update these terms. We will change the date at the top, and for material changes we will email account holders at least 30 days before they take effect. Continuing to use the service after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules, and the parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware.

If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence.

14. General

  • If any provision is held unenforceable, the rest stays in force.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these terms without our consent. We may assign them to a successor of our business.
  • These terms, the Privacy Policy, the Refund Policy and, where applicable, the Data Processing Addendum are the entire agreement between us.
